Coastal Scaffolding Systems — Terms & Conditions
- Introduction and acceptance
These terms govern every quotation, hire, sale, erection and dismantling service supplied by Coastal Scaffolding Systems, including Kwik-Stage scaffolding and formwork, and the use of coastalscaffolding.co.za. Placing an order, signing a delivery note, accepting delivery or paying an invoice means the Customer accepts these terms.
1.1 The supplier is Coastal Scaffolding Systems, Durban, KwaZulu-Natal (“Coastal Scaffolding”, “we”, “us”).
1.2 These terms override any terms on the Customer’s order or letterhead unless a director of Coastal Scaffolding agrees otherwise in writing.
1.3 Definitions:
- Customer: the person, company or entity that requests a quotation, places an order, or receives Equipment or Services.
- Equipment: Kwik-Stage scaffolding, formwork and decking components, tubes, fittings, frames, boards, ladders, towers, props, and any accessories supplied on hire or for sale.
- Services: delivery, collection, erection, alteration, inspection and dismantling of Equipment, including access scaffolding, bridging and suspended platforms, mobile and self-lock towers, birdcage scaffolds, seating stands, stages and pool covers, and formwork for columns, slabs, beams, retaining walls, ramps and staircases.
- Hire Period: from the date Equipment leaves our yard until the date it is returned to our yard, or collected by us, and checked in.
- Site: the location where Equipment is delivered or erected.
- Business Day: any day other than a Saturday, Sunday or South African public holiday.
- Quotations, orders and pricing
Quotations are valid for the period stated on the quotation and are based on the information and drawings the Customer supplies.
2.1 All prices are in South African Rand and exclude VAT unless stated otherwise.
2.2 Hire rates are charged for the period stated on the quotation, with any minimum hire charge shown there.
2.3 A quotation is not binding until we confirm the order in writing or deliver the Equipment.
2.4 We may adjust the price if the Site conditions, scaffold design, height, load class, access or programme differ from what was quoted, or if the Customer changes the scope. We will tell the Customer of the change before doing the extra work where reasonably possible.
2.5 Delivery, collection, transport, erection, alterations, dismantling, cleaning and repairs are charged separately unless included in the quotation.
2.6 Waiting time caused by the Customer or the Site (no access, no one to sign, unsafe conditions) may be charged as set out in the quotation.
2.7 Products shown in our online shop are for reference only. A “Request a Quote” submission is an enquiry, not an order, and no sale or hire exists until we confirm it in writing. - Hire period, delivery, erection and collection
Hire runs from the day Equipment leaves our yard until it is back in our yard and checked in; an off-hire notice alone does not end the Hire Period.
3.1 Delivery and collection dates are estimates. We are not liable for delays caused by weather, traffic, Site access, load-shedding, strikes or other events outside our control.
3.2 The Customer, or a person authorised by the Customer, must be on Site to receive Equipment and sign the delivery note. A signed delivery note is proof of the quantity and condition of Equipment delivered.
3.3 Any shortage or damage on delivery must be reported in writing promptly, failing which the delivery note is final.
3.4 To end the hire, the Customer must give written off-hire notice in advance and have the Equipment dismantled, stacked and ready for collection. Hire charges continue until the Equipment is collected.
3.5 Where we erect or dismantle the scaffold, we do so in line with SANS 10085-1 and the Construction Regulations, 2014. Only our competent persons may erect, alter or dismantle a scaffold we have erected.
3.6 The Customer must not alter, move, load beyond its rated class, or remove ties or parts from any scaffold. Any alteration must be requested in writing and is charged as extra work.
3.7 Equipment returned short is charged at full replacement value, and hire continues on missing items until they are paid for or returned.
3.8 For formwork and decking, the Customer must not pour concrete until the formwork has been inspected and approved by the Customer’s engineer or competent person. Pour rates, concrete loads and stripping times are the Customer’s responsibility unless agreed otherwise in writing. - Customer obligations and site safety
The Customer is responsible for the Site and for everyone who uses the scaffold once it is handed over.
4.1 The Customer must give safe, clear and level access to the Site, firm ground or suitable base support, and accurate information on loads, heights, overhead power lines and underground services.
4.2 The Customer is the employer or principal contractor in control of the Site for purposes of the Occupational Health and Safety Act 85 of 1993 and the Construction Regulations, 2014, unless agreed otherwise in writing.
4.3 After handover, the Customer must appoint a competent person to inspect the scaffold daily, weekly, and after bad weather or any incident, and keep a scaffold register on Site.
4.4 The Customer must stop use of the scaffold and notify us immediately if it is damaged, overloaded, altered, or appears unsafe.
4.5 The Customer must keep Equipment at the Site stated on the delivery note and may not sub-hire, lend or move it to another site without our written consent.
4.6 The Customer must allow us reasonable access to inspect, repair or recover the Equipment during the Hire Period. - Ownership, risk, loss and damage
Hired Equipment always remains the property of Coastal Scaffolding, but the risk of loss, theft or damage passes to the Customer on delivery.
5.1 The Customer may not sell, pledge, or allow any lien or attachment over the Equipment, and must notify us immediately if a landlord, creditor or sheriff tries to attach it.
5.2 Risk remains with the Customer until the Equipment is collected by us or returned to our yard and checked in.
5.3 Equipment returned dirty (cement, paint, plaster) is charged for cleaning. Equipment returned damaged is charged at repair cost or, if beyond repair, at full replacement value.
5.4 Lost or stolen Equipment is charged at the current replacement value, and the Customer must give us a police case number as soon as possible after discovering the loss.
5.5 For Equipment bought outright, ownership passes to the Customer only once the full purchase price is paid; risk passes on delivery. - Payment terms
Payment is due as stated on the quotation or invoice; approved account customers pay on the terms of their credit account.
6.1 Hire is invoiced as stated on the quotation for the duration of the Hire Period.
6.2 Credit accounts are opened only after a signed credit application, and we may require a personal suretyship from the directors or members of a company or close corporation.
6.3 Overdue amounts bear interest at the maximum rate allowed by law, calculated monthly from the due date until paid.
6.4 If any amount is overdue, we may suspend Services, refuse further orders, and collect our Equipment from the Site without further notice. The Customer must give us access for this purpose.
6.5 The Customer may not withhold or set off payment because of a dispute or counterclaim.
6.6 The Customer is liable for all legal costs of collecting overdue amounts, including attorney-and-own-client costs and collection commission.
6.7 Payment is by EFT to the account on our invoice. We will never change our banking details by email alone; confirm any change by phone before paying. - Cancellation, liability, indemnity and insurance
Our total liability for any claim is limited to the value of the order it relates to, except where the law does not allow that limit.
7.1 Cancellation. An order cancelled after delivery has been scheduled is charged for transport and any labour already booked. Custom-designed scaffolds cancelled after design work starts are charged for that work.
7.2 Exclusions. We are not liable for indirect or consequential loss, including loss of profit, production delays, penalties or third-party claims, unless caused by our gross negligence or wilful misconduct.
7.3 No liability for misuse. We are not liable for loss, injury or damage caused by the Customer’s misuse, overloading, alteration or failure to inspect the scaffold, or by anyone other than our employees.
7.4 Indemnity. The Customer indemnifies Coastal Scaffolding against all claims, losses and costs arising from the Customer’s use of the Equipment or breach of these terms.
7.5 Insurance. The Customer must insure hired Equipment for its full replacement value against loss, theft and damage, and carry public liability cover for the Site, from delivery until collection. We may ask for proof of cover.
7.6 Force majeure. Neither party is liable for failure to perform caused by events beyond its reasonable control, except for the Customer’s obligation to pay. - Website, privacy, consumer rights and general
These terms are governed by South African law, and nothing in them limits any right a consumer has under the Consumer Protection Act 68 of 2008.
8.1 Website use. Content on coastalscaffolding.co.za is general information, not engineering or safety advice. Prices, images and product details on the site may change without notice and do not form an offer. All logos, text and images on the site belong to Coastal Scaffolding and may not be copied without permission. The site uses cookies for Google Analytics and Google Ads conversion tracking, and an anti-spam service checks form submissions; you can block or delete cookies in your browser settings.
8.2 Electronic communications. In line with the Electronic Communications and Transactions Act 25 of 2002, orders, quotations, notices and signatures sent by email or WhatsApp are valid as if in writing.
8.3 Privacy. We collect and process personal information (names, contact details, ID or registration numbers, Site addresses) only to quote, supply, invoice, assess credit and recover Equipment, as allowed by the Protection of Personal Information Act 4 of 2013. We do not sell personal information. Quote requests sent through our website are delivered to us by a third-party form service, and WhatsApp chats are handled by WhatsApp; both process your details only to get your message to us. Customers may ask to access or correct their information by contacting our Information Officer at admin@coastalscaff.co.za.
8.4 Consumers. Where the Customer is a consumer under the Consumer Protection Act, any clause that conflicts with that Act applies only to the extent the Act allows.
8.5 Breach. If the Customer breaches these terms and fails to fix the breach within a reasonable time after written notice, we may cancel the agreement, collect our Equipment, and claim all amounts owing and damages.
8.6 Disputes and jurisdiction. The parties will first try to settle any dispute by negotiation. The Customer consents to the jurisdiction of the Magistrate’s Court for any claim, even if the amount exceeds its normal limits, though we may choose to proceed in the KwaZulu-Natal Division of the High Court.
8.7 Certificate of balance. A certificate signed by a director or manager of Coastal Scaffolding showing the amount the Customer owes is prima facie proof of that amount.
8.8 Changes and whole agreement. We may update these terms from time to time; the version on our website when an order is placed applies. These terms, the quotation and the delivery note are the whole agreement, and no variation binds us unless in writing and signed by a director.
